For outstanding Foreign University/College Graduates, how can you work in China? Here is the notice.

Notice on Allowing Employment for Outstanding Foreign University/College Graduates in China

Human Resources and Social Security Department (Bureau), Foreign Affairs Office, and Education Department (Education Committee) of all provinces, autonomous regions and municipalities directly under the Central Government:

In order to implement the "Mechanism of Talent Development and Opinions on Deepening the Reform of the System " [2016] No. 9 Document issuing by General Office of the CPC Central Committee), the authority is proposed to allow part of the outstanding foreign university/college graduates without work experience to work in China. In accordance with the "Administrative Regulations on the Employment of Foreigners in China", the relevant matters are hereby notified as follows:

1. The scope of applicable personnel

Foreign university/college graduates include the foreign students who have obtained master's degree or above in Chinese universities/colleges and graduated within one year, as well as the foreign graduates who have obtained master's degree or above and graduated within one year from well-known overseas universities/colleges.

2. The conditions for approval
For foreign university/college graduates to work in China, the following conditions should be met:

(1) Being at least 18 years of age and in good health;

(2) No criminal record;

(3) Excellent academic performance, with an average score of not less than 80 points (percentage system, other score systems should be converted into the percentage system) or B+/B (level system) above, and no record of misbehavior during school;

(4) Obtaining the corresponding qualifications and degrees;

(5) Getting certain employers and engaging in the posts that are in accord with the majors that the applicants have studied. In principle, the salary should not be lower than the average wage of the local employees in the local urban units. The specific standards are determined by the provincial human resources and social security departments according to the reality of employment market and the demand of introducing talents;

(6) Carrying valid passport or other international travel documents that can replace the passport.


3. The handling procedures
Employers who employ qualified foreign university/college graduates should apply to the local human resources and social security department or the foreign expert management department, and provide the following materials:

(1) Resume of the person to be employed;

(2) Employer intention letter (including intentional remuneration);

(3) Report of reasons for employment (including the 30-days certification proving that the local public employment and talent service organization have publicly released the recruitment information to domestic workers for 30 days);

(4) Proof of the health status of the person to be employed;

(5) The no criminal record certificate of the person to be employed;

(6) Certificates of academic degree and qualification obtained by the person to be employed;

(7) Proof of no record of misbehavior during the school period (excluding the foreign graduates from overseas universities/colleges) and certificate of achievement issued by the school where the person to be employed studied;

(8) The Portrait photograph taken within 6 months for the person to be employed.

  The human resources and social security department or the foreign expert’s management department shall examine and approve the submitted materials according to regulations. The foreigner's employment permit (or work permit, the same below) and the foreigner's employment certificate (or work certificate, the same below) will be issued to eligible foreign students.
 The foreigners work permit is issued to qualified foreign graduates from overseas universities/colleges. Those who have obtained the foreigner's work permit shall apply for a Z-type visa in accordance with the regulations and apply for the foreigner's work certificate after entry.

4. Other matters

(1) The period of validity of the foreigners work permit are 1 year for the first time. If the employment expires and the employer intends to extend, they may continue to employ them after completing the examination and approval procedures as required, with a term of no more than 5 years. If the personal income tax paid by a foreign university/college graduate is lower than the tax payable for intentional remuneration, or the salary that the employer intends to offer is lower than the prescribed standard, the work permit will not be extended.

(2) The quota management is implemented on the foreign university/college graduates work in China. The provincial human resources and social security departments shall, according to factors such as the quantity of foreign university/college graduates demanded by the local enterprises and the employment situation of local university/college graduates in the region, propose the demanded quota quantity and submit it to the Ministry of Human Resources and Social Security before December 1st of each year. The Ministry of Human Resources and Social Security will comprehensively study and determine the national and provincial (district, city) quotas for the next year. The results will be publicized in an appropriate manner and copied to the diplomatic, educational, and public security departments for implementation. The quota demands for 2017 should be submitted by the provincial human resources and social security departments before January 31st, 2017.
